A Chatham man accused of killing a Tilbury teen in a fatal head-on crash will find out next month if his case will go to trial.
Jaise Thomas, 26, was in Chatham court on Tuesday to hear submissions from the prosecution and defence during a preliminary hearing to determine if there's enough evidence to go to trial.
His lawyer pleaded not guilty earlier this month and selected a trial by jury, if the judge decides there's sufficient evidence to have a trial.
The prosecution wants Thomas indicted for dangerous driving and presented case law during his argument.
The defence wants his client discharged because there's not enough evidence to go to trial. The defence said Thomas had a momentary lapse of attention, adding the prosecution didn't prove the case.
The judge's decision is anticipated on February 19.
Thomas is charged with dangerous driving causing death in connection with the deadly crash on Queen’s Line between Wheeler Line and Davidson Road, just outside of Tilbury, on January 20, 2025.
The collision claimed the life of 18-year-old Sebastian Belliveau.
A publication ban prevents any evidence from the preliminary hearing from being made public.
